Plain answers to the questions that actually decide whether you can use this.

This summary is not the agreement, but nothing below contradicts it. If it does, the detailed terms win and we have made a mistake worth telling us about.

1. Who you are contracting with

Pixelite is operated from the pixelite.art domain and reachable at support@pixelite.art. By creating an account you agree to these terms; if you do not, do not create one.

Payments are processed by Polar Software, Inc., acting as merchant of record. That means Polar Software, Inc. is the seller on your receipt and handles sales tax and VAT. We never receive or store your card details.

2. Your account

You need a confirmed email address. You are responsible for what happens under your account, so keep your credentials to yourself. You must be old enough to form a contract where you live — generally 18, or 16 with your guardian's consent.

One person, one account. Creating additional accounts to collect the free signup credits repeatedly is fraud against us, and we will close all of them.

3. Credits

Generation is paid for in credits. Credits are a prepaid balance for using this service. They are not money, not a stored-value instrument, and not transferable between accounts.

  • Credits do not expire. A balance you bought stays yours.
  • Prices in credits may change; anything already in your balance is unaffected.
  • Every debit and credit is recorded in a ledger you can inspect at any time.
  • If a generation fails, or fails our quality checks, the credits are returned automatically. You are never charged for our failures — see the Refund Policy.

We apply rate limits and daily spending caps. These exist to stop a runaway script from draining your balance and to keep the service affordable for everyone. If you hit one, nothing is charged.

4. What you make is yours

You own every asset you generate, in full, and may use it commercially without restriction, attribution or revenue share. This applies on every plan, including free credits. We claim no ownership and grant ourselves no licence over your work beyond what is technically required to store it and show it back to you.

5. Originality is not guaranteed

Assets are produced by a generative model (Retro Diffusion) trained on large image datasets. We do not and cannot warrant that any output is original, or that it does not resemble existing artwork. Nobody offering this kind of service can honestly say otherwise, and you should be suspicious of anyone who does.

The legal status of AI-generated images — including whether they attract copyright at all — differs by country and is actively changing. In the United States, works without human authorship are currently not registrable. You are responsible for deciding whether that matters for your project, and for your own use of what you generate.

6. Training

We do not use your prompts, uploads or generated assets to train models, and we do not sell or share them for that purpose. If we ever want to, we will ask, and it will be opt-in with a real choice — not a pre-ticked box in an updated policy.

We do record whether a generation passed or failed our quality checks, and aggregate that to improve the pipeline. That is a pass/fail signal, not your artwork.

In the other direction: you may not use assets generated here to train, fine-tune or distil any model — not only an image one. That is a condition Retro Diffusion places on the images their model draws, so it is not ours to waive. If you have a research use, ask and we will put it to them. Otherwise: use them in your game.

7. Acceptable use

Some prompts are refused — recognisable franchise characters, living artists' names, and the categories listed in the Acceptable Use Policy. Attempting to defeat those filters, reselling raw generation capacity as your own service, or scraping the API outside your rate limits will end your account.

If you upload a reference image, you are stating that you own it or have permission to use it. We retain that statement.

8. Availability

This is a small service that depends on a third-party model provider. It will sometimes be slow, and it will sometimes be down. We do not offer an uptime guarantee or an SLA, and we will not pretend to.

What we do commit to: an outage never silently consumes your credits, and we will say what is actually wrong rather than describing a total failure as degraded performance.

9. Ending the agreement

You can close your account whenever you like. Unused credits are non-refundable on voluntary closure — buy what you expect to use.

We may suspend or close an account for breach of these terms, for fraud or chargebacks, or if required by law. Where we reasonably can, we will tell you first and give you a chance to export your work.

After closure your projects and assets are retained for 90 days so the decision is reversible, then deleted. See the Privacy Policy.

10. Liability

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

Subject to that: the service is provided as-is; we are not liable for indirect or consequential loss, including lost profits or lost data; and our total liability for any claim is capped at the greater of the amount you paid us in the twelve months before it arose, or US$50.

If you are a consumer, you keep every statutory right you have where you live, and this section does not take them away.

11. Changes

We may change these terms. For anything material we will give at least 30 days' notice by email, and the change will not apply retroactively to credits you have already bought. Continuing to use the service after a change takes effect means you accept it; if you do not, close your account and tell us — we will discuss a refund of an unused balance.
